The US Olympic and Paralympic Committee and USA Athletics now also allege that CAS initially sent “critical communications” to the wrong email addresses, and as a result, the parties were unable to properly prepare for the hearing.

“The USOC strongly disagrees with the CAS decision due to significant procedural errors,” the USOC told CNN on Thursday. “Between August 6 and 9, CAS sent critical emails to the wrong email addresses at the USOC and USA Boxing, an error that was not corrected until August 9 — three days after the application was filed, two days after the deadline for objections, and less than 24 hours before the hearing.

“This has denied us sufficient time to respond meaningfully or gather the necessary evidence. We have immediately notified CAS of our objections.”

Both sides said they would continue to appeal the matter.

“Our relentless pursuit of the truth in this matter remains steadfast,” the US Olympic and Paralympic Committee said.

The national governing body also expressed concerns about Dr. Hamed J. Gharavi, who has represented Romania in previous arbitration cases and who chairs the CAS arbitration panel. CAS says none of the parties involved objected to Gharavi’s appointment to the panel, but USA Gymnastics claims it was never informed of his ties to Romania.

“CAS has not sent any conflict of interest disclosures to USA Gymnastics from any of the panel members, and we have not seen the disclosures to date,” the statement said.
